Abstract

The article deals with theoretical and practical aspects of the concept of foreign trade transaction: doctrinal approaches to the definition of the concept of foreign trade transaction; qualifying attributes of a foreign trade transaction in the light of Russian legislation; overlaps between foreign trade transaction and international commercial contract (international commercial agreement, international commercial transaction). Contrary to the current trend to equate concepts of "foreign trade transaction" and "International commercial contract" the authors concluded wrongfulness of such an approach.

In fact, currently we can often see an identification of two different legal categories, one of which serves as the object of national state-power relations, and the second of which is included in the structure of international private law relations. According to the authors, in the Russian legal science unified qualifying attributes of both - a foreign trade transaction and an international commercial contract, - are absent. A widely accepted criterion of the location of a commercial enterprise in different states is considered by the authors in critical perspective. The definition of a foreign trade transaction in a public law aspect and the qualifying features of a commercial contract as a category of private international law are also provided in the article.
