Abstract

In article powers of the President of the Russian Federation in the sphere of criminal trial are considered. The Criminal Procedure Code of the Russian Federation stipulates the following similar powers of the head of state: the announcement of pardon, temporary discharge from a position of the highest public official of the territorial subject of the Russian Federation, discharge from a position of the Prosecutor General of the Russian Federation and the Chairman of Investigative Committee of the Russian Federation at the solution of situation of excitement concerning them criminal case. In work the procedural order of realization by the President of the Russian Federation of appropriate authority is analyzed. By results of a research the author formulates a conclusion according to which investment of the President of the Russian Federation with some powers in the sphere of criminal trial allows to balance criminal procedure activity. At the same time further expansion of powers of the President of the Russian Federation is not required.
